Process Serving · Florida
Have summonses, complaints and other court papers served anywhere in Florida, ordered and tracked from one account. Below: who can serve papers in Florida, how service is made, the deadlines, the proof of service form and our prices.
Process serving through Legal Hub Group is for law firms, attorneys and their staff. Representing yourself? Our sister company Famous Legal Services handles serves for individuals.
How it is done
Delivering a copy of the process, with a copy of the complaint or other initial pleading, to the person to be served. Fla. Stat. § 48.031(1)(a) ↗
Leaving the copies at the person's usual place of abode with anyone living there who is 15 or older, and telling them what the papers are. Fla. Stat. § 48.031(1)(a) ↗
Substituted service on the person's spouse may be made anywhere in a county by an authorized server, if the case is not an adversarial proceeding between the spouse and the person, among other conditions. Fla. Stat. § 48.031(2)(a) ↗
Who
Process is served by the sheriff of the county where the person is found, except that nonenforceable civil process (such as a summons) may also be served by a special process server appointed by the sheriff or by a certified process server. Fla. Stat. § 48.021(1) ↗
The chief judge of each judicial circuit may keep an approved list of certified process servers who meet the requirements of section 48.29; each is subject to annual recertification. Sheriffs may separately appoint special process servers. Fla. Stat. §§ 48.27(1), 48.021(2) ↗
Timelines
Our first-attempt promises:
Every attempt shows in your account as soon as the server logs it.
The court's deadline for service: If initial process and the initial pleading are not served on a defendant within 120 days after the pleading is filed, the court must order service within a set time, dismiss without prejudice, or drop that defendant; it must extend the time for good cause or excusable neglect. Fla. R. Civ. P. 1.070(j) ↗
Proof
Return-of-service form. The server notes on a return-of-service form the date and time the process came to hand and was served, the manner of service, the name of the person served and every document served, and signs it. Fla. Stat. § 48.21(1) ↗
Your server's proof is built from the field record of the serve.
