How do I serve someone in California?
Court papers have to be delivered by someone aged 18 or over who is not a party to the case, which is why most filers use a registered process server. You submit the documents and the address, a registered server makes the attempts, and you receive a completed proof of service to file with the court. Which method applies to your matter is a question for you or your attorney.
How many attempts does a process server make?
There is no single fixed number. Attempts are made at varied times and on varied days, and how many it takes depends on the address, the person's routine, and what the matter requires. Every attempt is logged with a GPS fix and a time stamp, so you can see exactly what was tried and when rather than taking it on trust.
What happens if the person can't be served?
Personal delivery is not the only route. California also recognizes substituted service, where the papers are left with a suitable person at the home or workplace and then mailed to that same address. Our platform will not issue a proof of service after a substituted serve until the required follow-up mailing has been logged. Which route is appropriate in your case is a decision for you or your attorney.
