What Is Insufficient Service of Process?
"Insufficient service of process" means the papers were not delivered in a way the rules allow: the wrong person, the wrong method, or a step skipped. It is the federal courts' name for the defense; California state courts raise the same problem with a motion to quash. Other states have their own procedures.
In federal court
- Insufficient service of process is one of the defenses a defendant may raise by motion before filing an answer (Federal Rule of Civil Procedure 12(b)(5)).
- It is waived if left out of a Rule 12 motion that raises other such defenses, or if not made by motion or included in the answer (Rule 12(h)(1)).
- If a defendant is not served within 90 days after the complaint is filed, the court must dismiss without prejudice or order service within a set time, extending it for good cause (Rule 4(m)).
In California: the motion to quash
- A defendant may file a motion to quash service of summons for lack of jurisdiction on or before the last day to respond to the complaint (Code of Civil Procedure section 418.10(a)(1)).
- It must be set for hearing no more than 30 days after it is filed, and filing it extends the time to respond until 15 days after notice of an order denying it (section 418.10(b)).
- If it is denied, the defendant may ask a higher court for a writ of mandate within 10 days after notice of the order, or up to 20 more days for good cause (section 418.10(c)).
- It may be filed with an answer, demurrer or motion to strike without making a general appearance, unless it is denied (section 418.10(e)(1)). Not making it when filing a demurrer or motion to strike waives objections including inadequacy of service (section 418.10(e)(3)).
- A general appearance counts the same as personal service of the summons (section 410.50(a)).
What makes service insufficient
Each method has its own requirements. For substituted service, for example, the adult who receives the papers must be at least 18 and told what they are, a U.S. Postal Service post office box cannot be used, and a copy must be mailed to the same address (section 415.20). Questions
What does insufficient service of process mean?
It is a defense that the papers were not delivered in a way the rules allow. In federal court it is listed in Rule 12(b)(5) and may be raised by motion before answering.
How is improper service challenged in California state court?
A defendant files a motion to quash service of summons on or before the last day to respond to the complaint (Code of Civil Procedure section 418.10). It must be heard within 30 days of filing, and it extends the time to respond until 15 days after notice of an order denying it.
Can the objection to service be lost?
Yes. In California, not making the motion to quash when filing a demurrer or motion to strike waives objections including inadequacy of service (section 418.10(e)(3)). In federal court the defense is waived if left out of an early Rule 12 motion or the answer (Rule 12(h)(1)).
