SC-108: Request to Correct or Cancel Judgment and Answer (Small Claims)
The request to fix a clerical error in a small claims judgment, or cancel it because the wrong law was applied, with the other side’s answer on page 2.
Optional form · Revised July 1, 2025 · 2 pages · SC-130 · Notice of Entry of Judgment
The form says SC-108 must be filed no later than 30 days after the clerk mailed the Notice of Entry of Judgment (SC-130), and that filing it does not extend the deadline to appeal. It cites Code of Civil Procedure section 116.725 and California Rules of Court, rule 3.2107.
When it is used
Only if you went to the trial
The form says a party who did not go to the trial must use SC-135, Notice of Motion to Vacate Judgment and Declaration, instead. For SC-108, the clerk mails copies to the other parties, who get at least 10 days to answer.
