What it is

Answering a contract claim

PLD-C-010 answers a complaint or cross-complaint for breach of contract. When it answers a cross-complaint, the form says plaintiff means cross-complainant and defendant means cross-defendant. It cites Code of Civil Procedure section 425.12.

When it is used

General or specific denial

Item 3 offers a general denial, which the form says not to check if the verified complaint or cross-complaint demands more than $1,000, or an admission of everything except statements the defendant says are false or has no information about.

  • The general denial in 3a is checked although the verified complaint demands more than $1,000.
  • Both 3a and 3b are checked; the form says to check only one.
  • Item 3b does not identify the paragraphs denied.
  • The answer is filed without proof of service on the plaintiff.
