What it is

The depository’s receipt

MC-356 is signed by someone authorized to act for the depository. It acknowledges receipt of the Order to Deposit Funds in Blocked Account (MC-355), which is attached, and of the funds. It cites Code of Civil Procedure section 372, Probate Code sections 3500 and 3600–3613, and California Rules of Court, rules 3.1384 and 7.953.

When it is used

No withdrawals without an order

The signer certifies that the account is an interest-bearing, federally insured blocked account and that no withdrawal of principal or interest will be permitted without a signed, file-stamped court order under the same case name and number.

Before you file

Common filing problems to check

These checks come from the official form and instructions. They are not a ranking of rejection reasons; the court decides whether a filing meets its requirements.

  • The copy of MC-355 the form says to attach is missing.
  • The form is signed by the party instead of someone authorized to act for the depository.
  • The account title in item 3 or the amounts in items 7–8 do not match the order.
  • The case name and number are missing, although withdrawals depend on an order under that name and number.
